Copyright Infringement Policy
Copyright infringement is the act of exercising, without permission or legal authority, one or more of the exclusive rights granted to the copyright owner under section 106 of the Copyright Act (Title 17 of the United States Code). These rights include the right to reproduce or distribute a copyrighted work. In the file-
Deluxe Barber College requires that users comply with all applicable federal, state, and local laws, including laws pertaining to copyright. This policy applies to those who use Deluxe Barber College network to share files, including (but are not limited to) Deluxe Barber College faculty and visiting faculty, staff, students, or guests accessing network services via Deluxe B. College computing facilities.
Campus network users who violate copyright law by using file-
Upon notification or due to detention, Deluxe Barber College’s computing and Information Services will take all necessary means, including but not limited to temporary disconnection from internet access, to stop illegal sharing of copyrighted material on its network by identified users.
Example of Activities Violating Federal Law
- Downloading and sharing MP3 files of music, videos, and games without permission of the copyright owner
- Using corporate logos without permission
- Placing an electronic copy of a standardized test on a department's web site without permission of the copyright owner
- Enhancing a departmental web site with music that is downloaded or artwork that is scanned from a book, all without attribution or permission of the copyright owners
- Scanning a photograph that has been published and using it without permission or attribution
- Placing a number of full-
text articles on a course web page that is not password protected and allowing the web page to be accessible to anyone who can access the Internet - Downloading licensed software from non-
authorized sites without the permission of the copyright or license holder - Making a movie file or a large segment of a movie available on a web site without permission of the copyright owner
Penalties for violation of federal copyright laws are as followed:
- Infringer pays the actual dollar amount of damages and profits.
- The law provides a range from $200 to $150,000 for each work infringed.
- Infringer pays for all attorney’s fees and court costs.
- The Court can issue an injunction to stop the infringing acts.
- The Court can impound the illegal works.
- The infringer can go to jail.
